Terms of service
These terms govern use of Queux by both sides of the marketplace — the creators who hire, and the setters who work. Where a section applies to only one side, it says so.
1. Acceptance of terms
By accessing or using Queux (“the Platform”) you agree to be bound by these Terms of Service. If you do not agree to them, do not use the Platform.
We may modify these terms. Continued use after a change takes effect constitutes acceptance of the modified terms, and material changes will be notified to account holders by email.
2. What Queux is
Queux is a platform that connects content creators (“Creators”) with appointment setters (“Setters”). It enables:
- Creators to build and manage a team of Setters
- Setters to handle direct-message outreach and appointment booking on a Creator’s behalf
- Tracking of leads, appointments, conversions and commission
- Integration with third-party services — Instagram and Facebook, Google Calendar, and Stripe
- Communication between Creators and Setters
Queux does not host your products, process your customers’ purchases, or replace your storefront. You keep the checkout, course platform and calendar you already use; Queux records the work that happens between the first conversation and the final outcome.
3. Accounts
3.1 Creating an account
You must create an account to use the Platform. You agree to provide accurate, current and complete information and to keep it up to date.
3.2 Security
You are responsible for the confidentiality of your credentials, and agree to notify us immediately of any unauthorised use of your account.
3.3 Account types
- Creator account — for creators building and managing a team of setters.
- Setter account — for individuals working with creators as appointment setters.
4. Subscriptions and payments
4.1 Plans
Access to certain features requires a paid subscription. Subscription fees are billed in advance, monthly or annually.
4.2 Trials and early access
New users may be offered a trial or early-access period. Unless cancelled beforehand, a trial converts to a paid subscription at the end of the trial period.
4.3 Refunds
Subscription fees are generally non-refundable. We may issue refunds at our discretion. Nothing in this section limits any right you have under consumer law that cannot be excluded.
5. Commission and payouts
5.1 Commission structure
Creators set the commission rates for their Setters, agreed between the two parties through the Platform. Rates may be a percentage of a sale, a flat amount, a fee per verified appointment, or a milestone. Queux does not take a percentage of commission.
5.2 Payout processing
Payouts to Setters are processed through Stripe Connect. A Setter must complete Stripe’s identity verification before receiving any money.
5.3 Hold periods
A Creator may set a hold period before a commission becomes payable. This exists to protect against refunds and chargebacks on the underlying sale.
5.4 Disputes between users
Commission is an agreement between a Creator and a Setter. Queux records what happened and provides the evidence trail, but is not a party to that agreement and is not responsible for resolving disputes between users. Users should resolve disputes directly and in good faith.
6. Code of conduct
By using the Platform you agree to:
- Act professionally and honestly in all interactions
- Not engage in spam, harassment or abusive behaviour
- Not misrepresent your identity or qualifications
- Not use the Platform for illegal activity
- Not attempt to circumvent Platform fees or commission tracking
- Respect the intellectual property rights of others
- Not share credentials or allow unauthorised use of your account
- Comply with all applicable laws and regulations
7. Setter responsibilities
As a Setter you additionally agree to:
- Send only messages that are truthful and not misleading
- Represent the Creator’s brand professionally
- Not make unauthorised promises or guarantees on a Creator’s behalf
- Keep the Creator’s business information confidential
- Complete identity verification through Stripe Connect
- Report accurate lead and conversion information
8. Creator responsibilities
As a Creator you additionally agree to:
- Pay agreed commission to Setters in a timely manner
- Provide accurate information about your products and services
- Not revoke Setter access in order to avoid paying commission already earned
- Maintain appropriate access controls on connected accounts
- Comply with the policies of connected services, including Meta and Google
9. Third-party integrations
9.1 Instagram and Facebook
Use of the Meta integrations is subject to Meta’s Platform Terms and the Instagram Terms of Use. You are responsible for complying with Meta’s policies, including those governing messaging and automation.
9.2 Google Calendar
Use of the Google Calendar integration is subject to Google’s Terms of Service. You authorise Queux to access and modify your calendar on your behalf.
9.3 Stripe
Payment processing is provided by Stripe under Stripe’s own terms. Queux is not responsible for Stripe’s actions, decisions or policies, including any decision to hold or reject a payout.
10. Intellectual property
The Platform, including its design, features and content, is owned by Queux and protected by intellectual property law. You may not copy, modify or distribute any part of it without permission.
You retain ownership of the content you create or upload. By using the Platform you grant Queux the licence needed to store, process and display that content in order to provide the service.
11. Termination
We may suspend or terminate an account for breach of these terms. You may cancel your account at any time from your settings.
On termination your right to use the Platform ends immediately. Provisions that by their nature should survive will survive — including payment obligations, limitation of liability and dispute resolution. Commission already earned before termination remains payable.
12. Disclaimer of warranties
The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that it will be uninterrupted, secure or error-free.
We do not guarantee any particular result from using the Platform, including leads generated, appointments booked or revenue earned.
13. Limitation of liability
To the maximum extent permitted by law, Queux is not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill.
Our total liability for any claim arising from your use of the Platform will not exceed the amount you paid us in the twelve months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Queux and its officers, directors, employees and agents against any claim, damage or expense arising from your use of the Platform, your breach of these terms, or your breach of any third-party rights.
15. Governing law
These terms are governed by the laws of the jurisdiction in which Queux operates, without regard to conflict-of-law principles.
16. Dispute resolution
Any dispute arising from these terms or from your use of the Platform should first be raised with us directly and pursued in good-faith negotiation. Where negotiation fails, the dispute will be resolved through binding arbitration, except where applicable law gives you the right to bring a claim in another forum.
